The banks, servicers and the federal government have created an alphabet soup of loan modiication programs. This is true because some loans are backed, owned, or guaranteed by Government Sponsored Enterprises (GSEs) like Fannie Mae and Freddie Mac. Such FHA loans have their own program underwritten by federal dollars with strict guidelines as to who does and does not qualify. Privately owned loans, any private label securitization trust, or a loan actually helf for investment by your lender, are not subject to any of the provisions of federal rules. The government cannot force a private party to modify your loan if the private party does not want to.
What this means in practice is this: unless Fannie or Freddie owns your loan, your lender doesn't need to provide you any reason for denying a modification. If fannie or Freddie does own your loan, you at least are entitled to an explanation for why your loan modification application was turned down.
If you are interested in finding out what the federal guidelines are, good luck finding them on the internet or on a government website. They aren't easy to find, and they are positively impossible to try to understand even if you do find them and they are way too complicated to want to read them.
